Official Rules (”Rules”)
No Purchase Necessary

PLEASE READ THESE RULES CAREFULLY. BY SUBMITTING A NOMINATION FOR THE AWARDS, YOU AGREE TO ABIDE BY THESE RULES.

Objective:
The Open Source for America Awards (”Awards”) are to recognize individuals, projects and deployments that support OSFA’s mission, found at http://opensourceforamerica.org

Eligibility:
NO PURCHASE NECESSARY. VOID WHERE PROHIBITED. To be eligible to nominate the winners for the Awards, you must be eighteen (18) years of age or older. Eligibility may be verified at any time.

Based on the quantity and quality of nominations received, awards may not necessarily be given in all categories.

Members of the Open Source for America (“OSFA”) Technical Steering Committee, OSFA Steering Committee, and OSFA Advisory Board are not eligible for the Awards, with the exception of the “Individual Contributor from within OSFA” award defined on the OSFA website.

The Prize:
OSFA is not obligated to compensate the winners in any way.

The winners will be announced on the OSFA website on or around October 11, 2011. Winners will be honored at FedTalks 2011 in Washington, D.C, or at a similar conference to be announced at a later date.

OSFA reserves the right to publish the names of all nominees and winners in any medium. Winners may be required to sign and return a Publicity Release in forms submitted by OSFA.

Selection Criteria:
Selection for the Awards will be completed in three phases. The first phase will be to accept nominations from OSFA members for each of the categories defined on the OSFA website (http://opensourceforamerica.org/awards). Nominations will be accepted at http://opensourceforamerica.org/awards between August 24, 2011 at 8:00 a.m EDT and September 13, 2011 at midnight EDT. The second phase will be the selection of finalists from among the nominees for each of the categories, by members of the OSFA Technical Steering Committee. In the third phase, Award winners will be chosen for each of the categories from among the finalists by members of the OSFA Board of Advisors.

Nominations:
Multiple nominations for the same project in a particular Category from the same submitter will be discarded.

The OSFA Technical Steering Committee reserves the right to re-classify any nomination to a more appropriate category.

You agree to indemnify, defend, and hold OSFA, its members and its affiliates harmless from any and all liability (including but not limited to claims, damages, losses or injuries of any kind) arising from or related to Your participation in the Awards. In no event will OSFA be liable to you for acts or omissions arising out of or related to the Awards.

You agree that OSFA is not responsible for nominations that are late, misdirected, incomplete, or otherwise not in compliance with these Rules (and such nominations will be disqualified). OSFA is not responsible for any error, omission, interruption, destruction or unauthorized access to or alteration of nominations; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers or providers, computer equipment, computer software, failure of any email or electronic notification to be provided by OSFA on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof, including any injury or damage to a submitter’s or any other person’s computer and/or its contents related to, or resulting from, participation in the Awards.

All nominations become the property of OSFA and will not be returned.

Odds:
The odds of winning in any category are dependent upon the total number of eligible nominations received.

General Conditions:
The Awards is governed by and interpreted in accordance with the laws of North Carolina, USA. You agree that the state or federal courts located in the Eastern District of North Carolina, USA shall be the exclusive venue for any disputes, claims, or causes of actions arising out of or connected with the Awards. The Awards is subject to all applicable federal, state provincial and local laws and regulations. The Awards is void where prohibited or otherwise restricted under any laws, rules or regulations.

Reservation of Rights:
If, for any reason, it is impossible or impracticable to run the Awards as planned, including infection by computer virus, tampering, bugs, unauthorized intervention, fraud, technical failure, causes beyond OSFA’s control, or other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Awards, OSFA reserves the right at its sole discretion, to cancel, terminate, modify and/or suspend the Awards and elect to award the Prize to winners drawn from among the nominations received at the time of cancellation.
